Honourable Mr. Manja,
The President of the Republic was acquainted with the letter no.2502 / 3 prot, dated 19.06.2019, of the Chair of the Commission for Legal Affairs, Public Administration and Human Rights of the Albanian Parliament.
The President of the Republic evaluates to inform the Committee on Legal Affairs, Public Administration and Human Rights of the Albanian Parliament, that the Decree no. 11199, dated 10.06.2019, “On the annulment of decree no. 10928, dated 05.11.2018 “On setting the election date for the local government bodies on June 30, 2019,” was taken in full compliance of the Constitutional provisions and in preservation of the fundamental principles deriving therefrom.
This decree is in force and it is published in the Official Gazette no. 84, Tuesday, June 11, 2019, and is consequently known and mandatory for implementation by all, including the Parliament of Albania.
The Decree of the President is an important act of a constitutional nature as well as taken in respect of the obligations of the Republic of Albania that originate from its adherence to international acts and engagement in the process of integration of the country into the European Union.
Specifically, this important act of the Head of State, which interrupted a fictitious election process, practically transformed into a voting process, without a contest and without alternatives, specifically is in accordance with Article 3 of Protocol no. 1 of the European Convention on Human Rights and the obligations that Albania has undertaken with the signing of the Stabilization and Association Agreement between Albania and the EU, that came into force since 29 August 2006.
Referring to these incontestable facts and arguments, the President of the Republic estimates that all the current parliamentary activity attempting to attack the activity of the President of the Republic, but not being able to overrule the contents of His decree, is a false process, unfounded on constitutional arguments, but only blindly politically oriented.
This fake and blindly political process does not serve at all to solving the deep crisis in which the country is situated, but rather it escalates it even further, as an uncontrolled effort to deepen the divisions between the sides and to annihilate every opportunity for creating a climate of dialogue and cooperation for which the President of the Republic has long and continuously been appealing to all the sides.
The President of the Republic is convinced that by his Decree no.11199, dated 10.06.2019, not only expressed the best effort to avoid a potential civil confrontation, in protection of the life and health of the citizens, of the democratic stability, the unity of the people and the constitutional order, but at the same time the President, by His act, has protected the constitutional principle of political pluralism on which the rule of law is built upon.
The President of the Republic guarantees the Parliament of Albania that He is exercising his duty, and is willing with full responsibility to take all the important decisions that will be dictated by the situation and the best interest of the country, in accordance with the powers given to Him by the Constitution and with His solemn oath to serving the general interest and progress of all the Albanian people!
Lastly, in continuation of your letter no. 2502/3 prot, dated 19.06.2019, the President of the Republic finds that the Commission on Legal Affairs, Public Administration and Human Rights at the Albanian Parliament has not been informed with the reasons of the Decree no. 11199, dated 10.06.2019 “On the annulment of Decree no. 10928, dated 05.11.2018 “On setting the election date for the local government bodies on June 30, 2019” and therefore, for a sound judgment (if this will be allowed to you), is provided attached to this letter.
